Frequently asked questions
Do I need an attorney to send a cease and desist?
No. Cease and desist letters can be sent by anyone. They are demands, not court orders. That said, for harassment, defamation, or IP claims, an attorney's involvement often makes the letter more persuasive — and avoids accidental admissions.
Is a cease and desist legally binding?
No, by itself. A cease and desist is a written demand. It is not a court order and does not compel the recipient to comply. Its purpose is to put the recipient on notice and create a paper trail before any litigation.
Should I send it by Certified Mail?
PostPal mails letters as standard USPS First-Class Mail. If you need signature confirmation or proof of receipt, Certified Mail with Return Receipt is a separate USPS product. Contact us before paying and we will recommend a route.
Will I have proof I sent it?
Yes. You receive a dated email confirmation when the letter is submitted, and the order page records the mailing date. The exact PDF that was printed is downloadable from the order.
Can I include exhibits or screenshots?
Yes. Up to five attachments (PDFs or images) can be printed and mailed with the letter — for example, screenshots of defamatory posts or copies of the disputed trademark filing.
